OK, cancel everything I said. What I was looking for the whole time, Mike had posted and I missed it. What I was looking for is:

"Once a team tenders a bid, that player is considered part of their active roster and the tendered salary counts against the teams cap."

While I think that sentence was written horribly (as it is not clear), that is the evidence I was looking for to justify why tenders count against the cap. My oppolgies for missing that and for wasting everyone's time. My bad.

I still don't like it, but at least I see it in the rules now.
