The reasoning: the RFA has to be applied to someone's cap at all times. If he truly did come off of your cap when bid out, then he would have to be on Insects cap right now. And then if I bid on him, he'd have to go onto my cap. Etc, etc. That wouldn't make sense. The cleanest and easiest way is for him to stay on the tendering team's cap until that team either gives him his release or re-signs him.

I can see why you'd think that. This isn't my call, but I'd be inclined to say that's fine. Ultimately, it's up to Jim, unless anyone is aware of a precedent when this has happened in the past - then that would govern.
