Time expired to make a cut (I believe)...so Tynes goes back to the FA pool. What penalties apply here, Burt?

Since Bell and Tynes sold at the same time (9/23 at 12am) and only one cut was made (two needed to be made), I figure Tynes is the one to go back into FA since the final bid on Tynes was placed later in the day on the 20th than Bell's final bid....am I correct?
