We knew he wanted Spiller anyway, but it was worth a 3rd to us to guarantee he couldn't change his mind! We already know we'd rather have Mathews (although it scares me to basically use San Diego's entire starting lineup every week).

That cannot be a binding part of the trade... gentleman's agreement sure, but we cannot allow players not already drafted to be part of a trade...sorry...
Dale you can take back your confirmation if you would like... But I think Bryan's word should suffice, as we all know he is SD homer almost as much as you are Denver homer.....

Clowns do NOT OWN the second pick I must give them one of my first round pick (I have two) the second pick and the third pick, that I got last year from the Dicipiles when I traded Brown to them for Plexico and their 2010 first see July 2009 trades.
I believe I choose the 1st round pick to give since it was not specified in the trade? Correct. |

http://www.predsff.com/forums/showthread.php?t=14378 does not specify which 1st...so not sure what your discussions were...when I talked to Clowns, they forgot they made that trade....
I do not think there is precedence for this (of course) - if you did not specifically tell Clowns that you wanted to give them the Disciples pick, or make it conditional that it was your choice or that it would be the later pick, then I would say it would be implied that it was your 1st round pick...usually if you are trading a pick of someone elses you got in a previous trade, that is specified...

Part of my discussions was the fact I had two 1st round choices once the trade was made in July I considered both 1st rounds MINE and when trading a 1st I simple thought I had two and when it came time to give it up (NOW) I would choose, that was the only way I would agree to that trade. NO one told me the 1st round I got was someone else it was always MINE in my mind.

you have to specify if you have two, the assumption is if you trade a first rounder and dont say which one, that it is your own.

I think I know where Shep is coming from on this one.. Especially as a new owner it would be very confusing to know which pick was 'naturally' his and which was acquired through trade. I would probably feel the same they were both MY picks at that point
So I do NOT agree with Scorpions 'assumption' that it should be Shep's 'natural' first round pick that was traded: I think that if the pick was not specified in the trade discussions (which it should've been!) then it is 'buyer (Clowns) beware' and Shep should KEEP his highest first round pick..
